Donald Smith waives right to speedy trial

JACKSONVILLE, Fla. -- A pretrial for Donald Smith was held Wednesday at 9 a.m.

Smith's attorney, Assistant Public Defender Fred Gazaleh, announced Smith was waiving his right to a speedy trial.

Defendants can waive their Sixth-Amendment right to a speedy trial, which allows for additional time to prepare. However, it means the trial may last longer.

The next pretrial for Smith, 56, is scheduled for October 15, 2013.

Smith, a convicted sex offender, has pleaded not guilty to the slaying, kidnapping and sexual battery of 8-year-old Cherish Perrywinkle.
