Hogan sex tape leaked, attorney issues stern warning

TAMPA, Fla. (WTSP) - Hulk Hogan's attorney has some stern words for the person or people responsible for handing over a sex tape of the former wrestler to the gossip website, Gawker.

"Don't sleep too well because we'll be coming for you," said attorney David Houston.

A portion of the video surfaced on the site on Thursday.

Gawker claims it was given to them by an anonymous person who did not want any money or credit, they only wanted them to watch.

Gawker not only watched the video, they published a portion of it and wrote up a play-by-play of the entire video.

Houston sent a cease and desist letter to the site Friday morning.

"I'm hoping Gawker will pay attention to the fact they are participating now in what I would consider to be a criminal act by way of continued republication of this particular disgusting footage," Houston told 10 News from his office on the west coast.

Houston says Hogan was not aware he was being recorded.

"The parties responsible for making this tape did so secretly, and without the knowledge or permission of Hulk Hogan," said Houston, "In my humble opinion, it is not only a crime, but it is also disgusting and against anything decent."

Gawker claims on its website that the video may have been taken from a surveillance camera in the bedroom of syndicated radio host, Bubba the Love Sponge.

The location and woman in the video have not been confirmed, but that doesn't matter to Houston, it's the fact the video was ever distributed, and then published, that has them promising to come after the anonymous source.

"We will do anything and everything we can to see whoever did this is prosecuted to the fullest extent of the law. We will utilize the civil statutes that will allow us to receive a monetary judgement as well, to do everything we can do to not only punish these people criminally if that is possible, but certainly put them out of business," he said.

This is not the first they've heard of the video. News broke on gossip sites earlier this year after someone was reportedly shopping around the tape.

"This tape was originally shopped around to several different companies, internet companies, and I'm happy to say the owners of those companies saw better than to attempt to purchase and market a tape that was obviously made without the knowledge and consent of Hulk Hogan" said Houston.

He said it is a mystery as to why the tape was released now.

Bubba the Love Sponge did not comment today.

Tampa attorney and Stetson Law professor Jim Lake says there could be a case here. In Florida, there are laws that protect you from being recorded when you should expect reasonable privacy, like when you are undressing ... and laws that protect the recording of your private conversations.

"If he didn't know his voice was being recorded, there could well be an issue here," said Lake. "There are a lot of things we don't know about this situation. Did someone make the recording on purpose, did the person who got the recording know what it was when he or she gave it to Gawker and that is one of the things the law would look at pretty closely," said Lake.

Houston says if Gawker does not remove the video from its site, he will take the "necessary steps".

"We will find these people and my only advice to them is not to sleep peacefully, we'll be coming."
