Morehouse rape suspect voluntarily submits DNA sample

ATLANTA -- One of three Morehouse College students facing allegations of rape and sodomy has voluntarily submitted a DNA sample to the district attorney, hoping to clear his name.

Chukwudi Ndudikwa completed the DNA test Wednesday. His attorney, Jackie Patterson, said he contacted the DA's office about the test and is confident it will come back negative.

"When you know you have a client that's innocent, why wait around until he gets indicted and have to go through a different process to try to clear his name," Patterson told 11Alive's Blayne Alexander Wednesday.

"Once [the test] comes back showing that he had no sexual contact with the alleged victim, I feel pretty confident that the district attorney will drop all charges."

Ndudikwa and a fellow student, Malcolm Frank, are facing rape and aggravated sodomy charges in an alleged incident involving a Spelman student. A third student, Tevin Mgbo, faces aggravated assault, kidnapping and reckless conduct charges. All three young men were members of the Morehouse College basketball team.

Patterson said his client just happened to be in the room at the time of the alleged incident, but had no sexual contact with the alleged victim, consensual or otherwise.

"No type of sexual contact. Not even sexual battery where you place your hand unlawfully on somebody's private parts," Patterson said. "He didn't do any of that."

The DNA results should be available in 2-4 weeks.
