JACKSONVILLE, Fla. -- The man who killed a Navy veteran and father has been spared the death penalty, but will spend the rest of his life in prison.
Deangelo Thomas was convicted of first degree murder in the April 2010 shooting death of David Gilbert in Gilbert's Westside apartment.
Thomas was convicted in February, but the jury deciding upon a sentence recommendation split evenly between life and death, leaving the decision up to the judge.
Judge Michael R. Weatherby today chose life in prison.
The sentencing was delayed because the original judge hearing the case, Jeff Morrow, died in early March.
The shooting happened two years after Thomas' 2008 release from prison on an armed robbery conviction. Thomas was arrested again for armed robbery in 2009, but was not convicted.
Gilbert was a father of three, and one of his daughters was with him at the time of his murder. She was unharmed.
