JACKSONVILLE, Fla. -- An appeals court in Tallahassee issued a temporary stay today after Judge Henry Davis banned a teenage girl who allegedly attacked a schoolmate from attending any public middle school in Duval County.
Attorney John Phillips, who represents the 14-year-old victim, said the alleged attacker, a schoolmate, is still banned from Oceanway Middle School, but she can now attend a different school in the district.
Phillips said he never asked for the alleged attacker to be banned from all public schools in the county and he doesn't know if Circuit Judge Henry Davis went too far when he made the landmark ruling.
The accused teen's attorney has filed a motion to disqualify Judge Davis and is asking that he be removed from the case.
