Lawsuit claims state outlaws computers and cell phones

JACKSONVILLE, Fla. -- Does the internet cafe ban in the state of Florida actually make all computers and cell phones illegal? That's what one Miami lawsuit claims.

The law defines illegal slot machines as any "system or network of devices" that may be used in a game of chance. Loosely, this could be any computer or cell phone.

The owner of Incredible Investments, LLC, is suing Katherine Fernandez-Rundle, the State Attorney for Miami-Dade County.

The introduction of the lawsuit states, "The Florida Legislature rushed to pass broad-sweeping amendments to existing statutes that violate the United States Constitution in a frenzy fueled by distorted judgment in the wake of a scandal that included the Lieutenant Governor's resignation."

The Tampa Bay Times says the argument was crafted with the help of a constitutional law attorney and Harvard professor. The law firm representing the owner of Incredible investments says under the law, the Legislature's own computers, "the ones they used to draft this legislation, are illegal."
