Beach Boulevard Automotive Sued by Attorney General

JACKSONVILLE, Fla. -- A recent state lawsuit claims Beach Boulevard Automotive engaged in deceptive business practices.

"The attorney general received 79 complaints against this car dealership for alleged violations of the deceptive and unfair practices act," Jenn Meale, spokesperson for the Attorney General Office.

The civil lawsuit claims eight allegations.

"Some of the allegations include using a GPS monitoring device with no knowledge to the consumer; requiring them to buy insurance when it wasn't actually required; and also repossession of certain cars," said Meale.

John King Sr., who owns Beach Boulevard Automotive, said the allegations in lawsuit have no foundation. "I think the attorney general is out of line," said King. 

King, who sells about 100 cars a month, said 14 months ago an investigator from the AG's office examined his business and found no violations. "We gave him 73 folders; they came back and said everything was completely accurate," said King.

King addressed the state's allegation that King puts GPS tracking monitors on sold vehicles without customers' knowledge. "We do that and there's no law against that," responded King.

The lawsuit also states the company requires gap insurance as a condition of the sale, but King said, "There's no condition of sale."

It also said King used threats with his customers. "What I do is if someone gets nasty with me, I get nasty with them," he said. "I do dial 911 and have them thrown off the property."

King called the lawsuit a fishing expedition and said he will vigorously fight the state to protect his business.

"When this case is over we'll prove that we're right and they're wrong and we'll file a federal lawsuit against the state of Florida," he said.
