Justin Barber Murder Case in St. Johns County Reopened

ST. JOHNS COUNTY, Fla. -- A St. Johns County murder trial which drew national attention has been reopened. 

Justin Barber stood trial for killing his wife on the beach.

Court documents show Barber is fighting the conviction with an appeal. In 2006, Barber was convicted for killing his wife, April. Prosecutors said Barber made up a story about an attacker who shot him and his wife on the beach at Guana River State Park.

The state argued that Barber's motive was a hefty life insurance policy and the ability to continue his extra-marital affairs.

However, Barber said someone else attacked them and that Barber drove away from the beach to find help for his bleeding wife. But now -- after a guilty verdict five years ago -- Barber's case is back in court.

He claims his attorney was ineffective and that there is new evidence which needs to be admitted.     

In 2006 from jail, Barber said, "Life in prison or the death penalty does not matter to me. What matters to me is that verdict was wrong."

Barber was sentenced to life in prison without the possibility of parole. Barber has a new attorney and another judge has been assigned to the case.
