VOLUSIA COUNTY, Fla. - Luis Toledo, the only suspect in the disappearance and presumed deaths of his wife and her two children, has now been indicted on two counts of first-degree murder in the children's deaths.
Officials said 31-year-old Luis Toledo admitted that he killed his wife, 28-year-old Yessenia Suarez, in October following a fight over divorce. However, he said someone else killed her children, Thalia Otto, 9, and Michael Otto, 8.
Toledo pleaded not guilty to second-degree murder for Suarez' death in November.
The bodies of Suarez and her children have not been located. They went missing Oct. 23.
The state attorney says they have forensic evidence that convinces them the children are dead too. The grand jury also indicted Toledo with tampering with physical evidence.
Suarez' family said they plan to file a wrongful death lawsuit against Toledo.
