The proceeding in the case of former Oklahoma State star Justin Blackmon is set for Tuesday in Payne County District Court. Blackmon's attorney, Cheryl Ramsey, says the first-round draft pick won't be present.
Police arrested Blackmon during a traffic stop in Stillwater June 3 after a breath test allegedly showed his blood-alcohol content to be three times the legal limit. Blackmon has pleaded not guilty to a misdemeanor count of driving under the influence.
Blackmon has apologized and says he'll abstain from alcohol use for now. He was arrested on a DUI charge in Texas in 2010 but the charge was reduced to underage alcohol possession.
