JACKSONVILLE, Fla. -  Allegations of misconduct against a Paxon Middle School teacher surfaced Wednesday morning after a 12-year-old student called her mother.

"She said, 'my teacher choked me and nuggeted me in my head'. I said, 'why did she do that?'. She said, 'I don't know. She was saying she was playing, but I wasn't playing with her'," the mother said.

First Coast News is withholding her name to protect the privacy of her child.

The school principal gave her written statements from witnesses today. A teacher's note said she and the students were "playing as usual" and she thought the student was kidding.

Classmates who witnessed the incident each wrote varying descriptions. One said she saw the teacher put her arm around the student's neck.  Another said he didn't think the teacher was trying to hurt the student.

"You don't have no right putting your hands on a kid - playing or not. That's against the law, that's against the rules," the mother said. "You are not supposed to touch a kid, much less choke them."

The Duval County Public Schools Board is investigating and issued a statement that said, "The teacher has been removed from the classroom and placed in a non-teaching environment pending the outcome of the investigation."

But the mother is demanding the teacher be punished.  "If my daughter would have hit her, my daughter would have been in jail."
