JACKSONVILLE, Fla. -- The man who is charged with the murder and kidnapping of 8-year-old Cherish Perrywinkle was arrested in 2009 for impersonating a Department of Children and Families worker.

Donald James Smith, 56, a registered sex offender who served prison time for attempted kidnapping and for committing lewd and lascivious assaults on a minor, was arrested by police in September 2009 after a lengthy investigation.

Stephanie Boggs told First Coast News in 2010 that Smith made an obscene phone call to her daughter.

"He asked her where she was. He asked her where she lived. He asked her if she was wearing a bra," Boggs said.
