DELAND, Fla. (AP) - A Winn-Dixie store is seeking to stop a gentleman's club from opening just feet away from its doors in a DeLand shopping center.
The Jacksonville-based company filed a complaint in circuit court on Oct. 7 and was granted a temporary injunction the next day. A hearing on a permanent injunction is planned for 9 a.m. Thursday.
The Daytona Beach News-Journal reports Winn Dixie alleges the shopping center's owner violated is lease agreement by allowing an adult establishment to move into the Brandywine Shopping Center.
Attorney H. Timothy Gillis says the 1982 lease agreement prohibits the plaza owner from leasing to anything other than retail stores without Winn-Dixie's consent. It specifically prohibits bars.
The club was set to open last Thursday.
